Liz of the HawaiiAnswers.com Hui answers: There are two parts to this. First, the person living there can be evicted if the rent isn\'t paid. That\'s a suit.

The second part of the question is whether the landlord can sue somebody for back rent after they move out, if they\'re not on the lease. The usual answer is no, if they\'re not on the lease.

I\'ve seen this come up in court on occasion, and the way the judges usually deal with it is to enter judgment only against the people on the lease. There is one exception. If the landlord can prove that there was an oral agreement with the person to pay the rent, then the court might hold that person liable. That does not happen very often.
